Last Will and Testament of Allen Johnson

In the name of God, Amen.

I Allen Johnson of the State of North Carolina and County of Johnston being of Sound and perfect mind and memory -- blessed be God -- do this 24th day of January, in the year of our Lord, one thousand eight hundred and forty eight make publish -- this my last will and Testament in manner following that is to say

1st all of my just debts and funeral charges to be paid.

2nd I give and bequeath to my dear beloved wife, Elizabeth Johnson, fifteen head of dry Hogs, together with eleven head of sheep, together with one thousand and seven hundred pounds of Bacon, together with one large stand of Lard, together with thirty five Barrels of corn, together with the three choice Pots, all all of the geese, and all of the knives and forks, and the cupboard in the kitchen, together with the contents belonging to the same, and the cupboard in the big house, and the contents belonging to the same, together with all of my beds, bedstands and furniture belonging to the same and two barrels of feathers, together with three cows and calves - choice, together with the choice one of my horse creaters, together with one horse cart & one yoke of steins and cart together with all my sitting chairs - and three blade stacks of fodder - choice, together with two small stairs, and two Tables choice, one side Saddle and one chest, and one clock, together with all of my plantations and the privilege of [raiss?] timber and fire woods to keep up the same, two woolen wheels and two pair of [pards?] - one Loom and gear, one Darth oven and spider choice, and one frying pan, and seven bushels of oats all of the juniper ware of all kinds - all of my books of every denomination and my best “wriding” Saddle - seven cider barrels, together with a child's part of my perishable property that is not named in my will - three axles - three areiding [sic? aerating] hoes, two grubbing hoes and Hatchet - six plows and stocks - choice, one set of plow gear - choice, all of my Potatoes.

3 I lend to my dear beloved wife Elizabeth Johnson one negro boy by the name of Archer, until my youngest child arrives to the age of twenty one years old.

4. My request is, for my Executors hereafter named to sell all of my perishable property that is not given to my wife by will, and after paying all my just debts, the balance to be equally divided amongst my lawful children.

5th And I hereby make and ordain my two brother-in-laws, Budd Smith and Westbrook Lee, Executors of this my last will and Testament, and further, I appoint Westbrook Lee, to be guardian for all my lawful children.

In writing whereof, I the [s'd.?] Allen Johnson have, to this my last will and testament, set my hand and seal - this the day and the year written.

Signed, sealed, published declared by the [S'd?] Allen Johnson, the Testator, as his last will & Testament, in the presence of us, who [were?] present at this time of signing sealing thereof.

Probate

Johnston County -- Probate Court

A paperwriting purporting to be the last will and testamanet of Allen Johnston, deceased, is exhibited for Probate, before me, P. T. Massey, Judge of Probate for said County, and thereupon, Joel Lee and Harry Johnson, two of the subscribing witnesses thento being duly sworn each deposed and said:

That they are each subscribing witnesses to the said will, and that the said Allen Johnson subscribed the same in each of their presence. They further said that the said Allen Johnson at the time of subscribing the same declared the said writing to contain his last will and testament, and they did each thereupon, at the request and in the presence of the said testator, subscribe their names and attesting witnesses thereto. And further, that at the time of the subscribing aforesaid, the said Allen Johnson was of sound mind and memory, of full age to exercise a will, and under no restraint to their knowledge or belief.

Thereupon, it is adjudged by the Court that the said paper writing and every part thereof, is the last will and testament of the said Allen Johnson and the same is ordered to be recorded and filed.
