Will of Anna E. Ingram

I, Anna E. Ingram of the County of Johnston and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this to be my last Will and Testament in manner and former following: That is to say --

First I desire my executor hereinafter named to provide for my body a decent burial suitable to the wishes of my friends.

Secondly I desire that all my just debts be paid out of the first monies that may come into the hands of my executor as a part or parcel of my estate.

Thirdly My will and desire is that my beloved Sister Kissey Weaver should she survive me shall own and possess and I hereby bequeath to her all my property both real and personal estate that I may be seized and possessed of at the time of my decease.

Fourthly I appoint and constitute my friend E A Bizzell to be Executor to this my last Will and testament.

Dated August 4th day in the year 1874.

Signed in the presence of us at the request of the testatrix in her presence and in the presence of each other as Witnesses hereto -- This the 4th day of August 1874.

State of North Carolina Johnston County - In the Superior Court

A paper purporting to be the last Will and Testament of Anna E. Ingram deceased is exhibited before me, the undersigned, Clerk of Superior Court for said County by W N Ross Jr. and the due execution thereof by the said Anna E. Ingram is this day duly proven before me by the oath & examination of P H C Duprie & W. A. Bass the subscribing witnesses thereto: who being duly sworn doth before and say, and each for himself deposith and saith, that he is a subscribing witness to the paper writing now shown him, purporting to be the last will and testament of Anna E Ingram, that the said Anna E. Ingram at the end of said paper-writing which is now shown as aforesaid and which bears date of the 4th day of August 1874.

And the deposent further saith that the said Anna E Ingram the testatrix aforesaid, did at the time of subscribing her name as aforesaid, declare the said paper writing as subscribed by her and exhibited, to be the last will & testament, and this deposent did therefore subscribe his name at the end of said will as an attesting witness thereto and at the request and in the presence of the said testatrix --

And this deposent further saith that at the said time when the said testatrix subscribed her names to the said last Will as aforesaid, and at the time of deponents subscribing his name as an attesting witness thereto as aforesaid, the said Anna E Ingram was of sound mind & memory, of full age to execute a will, and was not under any restraint to the Knowledge, information or belief of this deposent.

And further these deposents say not.

Severally sworn & subscribed this 10th day of Jany 1890 before me

In the matter of the will of Anna E Ingram deceased. A paper writing purporting to be the last will & testament of Anna E Ingram deceased, is exhibited for Probate before me L R Waddell Clerk of Superior Court for said County by W N Rose Jr having been duly sworn, each deposed & said: That they are each, a subscribing witness to said will, and that the said Anna E Ingram subscribed the same in their presence. They further said that the said Anna E Ingram at the time of subscribing the same, declared the said writing to contain request and in the presence of the said testatrix subscribe their name as an attesting witness thereto --

And further, that at the time of subscribing, as aforesaid the said Anna E. Ingram was of sound mind & memory, of full age to execute a will, and under no restraint to their knowledge or belief. Thereupon, It is adjudged by the Court that the said paper writing, and every part thereof, is the last will and testament of the said Anna E Ingram and the same is ordered to be recorded and filed.

And thereupon (E A Bezzill the executor named therein being dead) Kizzie Weaver sister & [legator?] is duly qualified as administratrix with will annexed. Let Letters of administration with will annexed be issued accordingly.
