Roswell Manley's Will

Be it remembered that at the Court of Probate held at the Court House in the Town of Ravena within and for the County of Portage and State of Ohio on the fifth day of March in the year of our Lord one thousand eight hundred and fifty two Before me Luther L Brown Judge of said Court The last Will and testament of Roswell Manley of Nelson in said County was produced in Court for Probate and David Chamberlin and Hiram Pierce subscribing witnesses of said Will appeared and in open Court on oath testified to the due execution of said Will and it appearing to the Court by said testimony that said will was duly attested and executed and that the said testator at the time of executing same was of full age and sound mind and memory and not under any restraint it was ordered by the Court that said Will and testimony be recorded which said will and testimony follow in these words to wit.

Will

In the name of the Benevolent Father of all, I Roswell Manley of the Township of Nelson County of Portage and State of Ohio do make and publish this my last will and testament viz

Item 1st It is my will that my funeral expenses and all just debts be paid and that a suitable Tomb stone be erected at my grave.

Item 2nd I give and bequeath unto my beloved wife Clarrissa Manley in lieu of dower the farm on which we now reside situate in the Townships of Nelson and Windham County of Portage and State of Ohio containing about one hundred and fifty acres of land be the same more or less. I also give and bequeath to my wife Clarrissa all my house hold and kitchen furniture also all the stock including Horses Cattle Sheep Hogs and Hens, but not including Jacks or Gineyes [sic Ginnies] that may belong on said farm at the time of my decease and also all the farming tools on said place together with all wagons Buggys Sle[i]ghs Harnesses Buffaloes Sleins and all grain and hay belonging to said place at the time of my decease also one fourth of the income for the years of what we call the sugar place lot supposed to contain about twenty two acres she paying to Elizabeth Ann Henry fifty dollars when said Elizabeth Ann Henry shall arrive at the age of eighteen years provided said Elizabeth Ann Henry shall continue to live with her and is a good girl untill that time.

Item 3rd I give and bequeath to my daughter-in-law Cordelia S. Manley two hundred dollars.

Item 4th I give and bequeath unto my Grandson Roswell Mortimer Manley one thousand dollars when he shall arrive at the age of twenty-one years.

Item 5th I give and bequeath unto my nephew Francis Drummonds fifty dollars when he shall arrive at the age of twenty one years.

Item 6th I give and bequest unto my son Orvill Manly in addition to the one hundred and fifty acres of land of which I have already made a deed to him the remainder of all my property which I may have at the time of my decease both real and personal including all moneys debts due me or rights in action also the use of the sums herein bequeathed to Roswell Mortimer Manley and Francis Drummonds untill they shall arrive at the age of twenty one years the rest that shall remain after my funeral expenses and debts have been paid and not herein mentioned to be his.

Item 7th I do hereby nominate and appoint Orvill Manley executor of this my last will and testament.

I do hereby revoke all former wills by me made.

In testimony whereof I have hereunto set my hand and seal this twenty first day of February in the year one thousand eight hundred and fifty two.

Signed and acknowledged by said Roswell Manley as his last will and testament in our presence and signed by us in his presence.

We David Chamberlin and Hiram Pierce being duly sworn in open Court this fifth day of March A.D. 1852 depose and say that we were present at the execution of the last will and testament of Roswell Manley hereunto an[n]exed that we saw the said testator subscribe said will and heard him publish and declare the same to be his last will and testament and that the said testator at the time of executing the same was of full age and sound mind and memory and not under any restraint and we signed the same as witnesses at his request and in his presence and in the presence of each other.
